1. Acceptance of Terms

By accessing or using Clinical Note AI (“the Service”), you agree to be bound by these Terms of Service.

2. Description of Service

Clinical Note AI provides AI-assisted clinical documentation tools for mental health clinicians. The Service transforms raw session notes into structured clinical documentation formats (SOAP, DAP, BIRP, Progress Notes).

3. Not a HIPAA Business Associate

Clinical Note AI is NOT a HIPAA Business Associate. The Service is designed so that no Protected Health Information (PHI) needs to be entered. You must use client codes, initials, or identifiers — never real patient names, dates of birth, or other PHI. You are solely responsible for ensuring your use of the Service complies with HIPAA and any other applicable laws.

4. User Responsibilities

You agree to: (a) use only de-identified client codes, not real patient names; (b) maintain your own HIPAA-compliant documentation workflow; (c) review and edit all AI-generated notes before placing them in patient records; (d) not rely solely on AI output for clinical decision-making.

5. Subscription and Billing

Paid plans are billed monthly. You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

6. AI Disclaimer

AI-generated notes are drafts only. You as the licensed clinician are solely responsible for the accuracy, completeness, and appropriateness of all clinical documentation. Always review AI output before use.

7. Limitation of Liability

Clinical Note AI shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

8. Changes to Terms

We may update these terms with 30 days notice. Continued use after notice constitutes acceptance.
